A power of attorney form is a legal document that allows you to appoint some one who is willing to act on your behalf in a matter of your choosing. For example, power of attorney forms are used a lot by deployed soldiers who want their wives back home to have access to their bank account.
Discussing wills and durable powers of attorney with your parents can be somewhat scary for most people. I think there are a number of reasons for this.
Life is all about seeing the unforeseen. It is about planning and executing the plans. However, we all believe in the one phrase that man proposes and god disposes, and this phrase is applicable in all spheres and aspects of life. Nobody can be assured that they know their future. We all try to calculate our future and find out various resources to know our future. Nevertheless, we are always left in some or the other mystery about our lives. In today’s harsh realities, people from all walks of life are always at the risk of getting into various accidents. More often than not, other people or groups of people have been engaged and could be held liable with the accidents that happened. It may be due to their connection in school, at work, or at a given community. Depending on how the physical, mental, or emotional harm is sustained, these incidents bring about personal injuries which may be slight or serious.
A will is a written document which gives instructions how and to whom the will maker (testator) wants to bequeath his/her property after death. An oral will can be made only by members of military and merchant navy in active service when they don’t have time to execute a written will due to exceptional conditions like war.
Any person above 18 with sound mental health can make a will. It must be dated and signed by the testator and certain number of witnesses, depending on the laws of the state. A hand written will, called ‘holographic will’, valid in 25 states, does not require witnesses.
Consumer law has been designed by the government to protect the consumers. In other words the consumer law or rights that exist protect consumer’s safety and public health. You will find that the consumer organizations have been formed to help consumers make better choices in the products they buy. Let’s look at a recent example for a moment. With trade in China many toys have come in with lead paint. This concerns the consumers as lead paint has been found to be detrimental to health. In the US regulations against the use of lead paint have been created. So for consumer law in the United States that importation of lead based products goes against the consumer laws of safety and public health. The items have of course been recalled based on the consumer law.
I received a letter in the mail from our “great state” of Illinois that they failed to protect the personal information I’m required to provide to be licensed to do business.
I followed their advice and put a fraud alert on my credit report then went to follow their suggestion that we monitor our own credit multiple times throughout this year. Each credit agency (Experian/Equifax/TransUnion)offered monitoring services for a monthly fee. They ranged from $9.95 to $14.95. Another added expense!
What is wrongful death?
An incident may be considered as wrongful death if an individual died due to other party’s neglectful acts, misconduct, omission or malpractice. The law therefore entitles the immediate family members of the deceased or the “distributees” to file charges against the defendant. The surviving spouse, children or sometimes the parents may hire their personal representatives in pursuing a wrongful death lawsuit. Due to the lack of federal wrongful death statutes in the U.S., every state law varies in its provisions as regards to the standard procedures in working at wrongful death actions.
As we all knew that internet piracy had grow enormously from the past few years, this trend had to be stopped and people have to be aware that pirating online or downloading pirated files online is an offence. We as a member of a law abiding society understand the concept that we cannot steal people’s property. Most of us would not steal, intend to steal and will generally be honest and not appropriating things that do not belong to us; when we need something, we buy. However, most of us seem unable to apply this ideology when we get connected online. We download without paying, utilizing software without purchasing, and generally think that we will not get caught by doing so. The lack of public awareness in internet piracy was one of the crucial elements which stimulate such act. By contrasting the degree of public awareness with the growth of online piracy, we can tell that there are still a lot to catch up in order to control and to eliminate it.
